LAW 743: Constitutional Tort Litigation

Constitutional torts basically are claims for monetary judgments brought under 42 U.S.C. section 1983 in which citizens seek monetary damages from state actors for alleged violations of constitutional rights. The major focus of the course will be a critical examination of section 1983 as a process of vindicating violations of constitutional rights. The subjects include the state action doctrine, liability of municipalities, the immunity doctrines, causation theories, Bivens actions against federal officials, limitations on monetary relief, and attorneys’ fees.
