LAW 897: Obtaining and Monitoring Relief in Institutional Reform Litigation

This course will analyze ways in which institutional reform can best be achieved and monitored. Through the use of case studies in school desegregation litigation and statewide public employment cases, students will focus on the legal basis for relief, the limitations on judicial oversight, and the practical aspects of achieving permanent institutional change. Issues to be addressed will include: monitoring of compliance in institutional reform cases; securing the productive involvement of parties and class members who may have differing viewpoints; and the use of dispute resolution means other than trial.
