Conflict of Laws: The Basics

This course will examine the basic elements of Conflict of Laws. The emphasis will be on choice of law and enforcement of judgments and only minimal consideration of jurisdictional issues. Each of the classes will primarily address what law should resolve an issue when a matter has contacts with more than one jurisdiction as well as whether and how a judgment can be enforced cross-border. Consideration will be given to common situations that arise in the context of (i) torts, (ii) contracts, (iii) corporations, partnerships, and other business entities, (iv) property, (v) wills and trusts, (vi) family law, and (vii) commercial transactions and e-commerce.
