A 2013 Stanford Law Review study co-authored by Lisa Bressman, Vice Dean and David Daniels Allen Distinguished Chair at Vanderbilt Law School, was cited by Justice Amy Cohen Barrett in her opinion and Justice Ketanji Brown Jackson in her dissent in FS Credit Opportunities Corp v. Saba Capital Master Fund.
Justice Barrett and Justice Jackson both cited the study “Statutory Interpretation from the Inside: An Empirical Study of Congressional Drafting, Delegation, and the Canons, Part 1.”
The first of two articles co-authored with Professor Abbe Gluck of Yale Law School, “Statutory Interpretation” examines the role that the legislative drafting process should play in statutory interpretation and administrative law. Their findings are based on an empirical survey of 137 congressional counsels drawn from both parties, both chambers of Congress, and multiple committees.
